2. Services
Light Application provides a cloud-based lighting control and monitoring platform designed to assist organisations, including local governments and commercial entities, in managing lighting infrastructure.
Access to certain features may require a separate written agreement. Where such an agreement exists, it will prevail over these Terms to the extent of any inconsistency.
3. Authorised Users
You agree to use the Platform only for lawful purposes and in accordance with these Terms. You must ensure that:

- Only authorised personnel use the Platform
- All applicable laws and regulations are complied with
You are responsible for all activities conducted under your account.
4. Service Availability
While we strive to maintain high availability, the Platform is provided on an “as available” basis. We do not guarantee uninterrupted or error-free operation.
Scheduled maintenance, upgrades, emergency works, telecommunications failures, cyber incidents, or events outside our control may result in temporary service interruptions.
You acknowledge that the Platform is one component of your operational environment and should not be relied upon as the sole safeguard for public safety.
5. Customer Responsibilities
You remain responsible for:
- The safe operation of lighting infrastructure
- Implementing appropriate operational procedures
- Maintaining backup controls where necessary
- Ensuring that automated settings are appropriate
Light Application is not responsible for field equipment failures, electrical faults, network connectivity, or third-party systems.
6. Cybersecurity and Misuse
You must not:
- Attempt to gain unauthorised access
- Interfere with system integrity
- Introduce malicious code
- Conduct penetration testing without written approval
- Use the Platform in a way that could damage infrastructure or public safety
We reserve the right to suspend access where a security risk is identified.
7. Intellectual Property
All intellectual property in the Platform, website, software, and documentation remains the property of Light Application or its licensors.
You are granted a limited, non-transferable licence to use the Platform solely for your internal business purposes.
8. Third-Party Services
The Platform may rely on third-party telecommunications, hosting providers, mapping services, or hardware integrations. We are not responsible for the performance of third-party services.
9. Limitation of Liability
To the maximum extent permitted by Australian law:
Light Application will not be liable for any indirect, consequential, or economic loss, including loss of revenue, loss of data, or business interruption.
Our total aggregate liability arising from or in connection with the Platform will not exceed the fees paid by you for the services in the preceding twelve (12) months.
Nothing in these Terms excludes rights that cannot be excluded under the Australian Consumer Law.
10. Indemnity
You agree to indemnify Light Application against claims arising from:
- Misuse of the Platform
- Unauthorised access
- Failure to implement appropriate operational controls
- Breach of these Terms
11. Suspension and Termination
We may suspend or terminate access where:
- These Terms are breached
- A security threat is detected
- Fees remain unpaid under a separate agreement
- Required by law
12. Privacy
Personal information is handled in accordance with our Privacy Policy.
13. Changes to Services or Terms
We may update these Terms from time to time. Continued use of the Platform constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of Western Australia. The parties submit to the exclusive jurisdiction of its courts.
